Haywood County Engineering Review Board

 Article I  Objectives 

The objectives and purposes of the Engineering Review Board of Haywood County are those set forth in Chapter 158 of the Haywood County Code of Ordinances: Slope Ordinance, and amendments and supplements thereto, and those powers and duties delegated to the Engineering Review Board by the Haywood County Board of County Commissioners by the Haywood County Slope Ordinance as adopted and effective March 1, 2007.

 Article II  Officers and Their Duties Section 1.  The officers of the Engineering Review Board shall consist of a Chairman and a Vice-Chairman.  Section 2.  The Chairman shall preside at all meetings and hearings of the Engineering Review Board and shall have the duties normally conferred by parliamentary usage of such officers, which include the appointment of committees.  Section 3.  The Chairman shall be any member of the Board, except those members employed by the County.  He shall have the privilege of discussing all matters before the Board and of voting thereon. Section 4.  The Vice-Chairman shall act for the Chairman in his absence.   Section 5. The County Engineer shall be responsible for keeping the minutes and records of the Board, preparing agenda of regular and special meetings with the Chairman, providing notice of meetings to Board members, arranging proper and legal notice of hearings, attending to correspondence of the Board and to such other duties as are normally carried out by the Secretary. Article III  Election of Officers Section 1.  Nomination of officers shall be made from the floor at the first meeting of the board; and thereafter at the annual organization meeting, which shall be held at the February meeting each year, and the elections shall follow immediately thereafter. Section 2.  A candidate receiving a majority vote of the entire membership of the Engineering Review Board shall be declared elected and shall serve for one year or until his successor shall take office.   Section 3.  Vacancies in offices shall be filled immediately by regular election procedure.

 

 

Article IV  Meetings

 Section 1.  Meetings of the Haywood County Engineering Review Board will be held quarterly on the second Monday of January, April, July, and October at 4:30 p.m. in the Haywood County Annex II Conference Room, or as called by the Chairman or County Engineer.  The location of the meetings may be changed at the discretion of the County Engineer, after consultation with the Chairman.  Every attempt will be made to notify in writing the Board members and the media of a meeting location change at least five days before the meeting.  If written notification is not possible, then telephone notice shall be made 48 hours prior to the meeting.  In addition, a change in the meeting location may occur prior to the start of official business, if there is a large number of people attending, and alternate space needs to be found to accommodate everyone. Section 2.  Four members of the membership of the Board (7 members) shall constitute a quorum and shall be the number of votes necessary to transact business.  Voting shall be either by roll call or by voice.  A record of the roll call shall be kept as a part of the minutes. Section 3.  Special meetings may by called by the Chairman and by the County Engineer when they see the need for such a meeting; the Board members may also request that a special meeting be held.  The County Engineer shall notify all members of the Board in writing not less than five days in advance of such special meetings.   Section 4.  All meetings shall be open to the general public. Section 5.  All members should attend Engineering Review Board meetings regularly.  Members should contact the County Engineer if they are unable to attend a meeting. Article V  Hearings Section 1.  In addition to those required by law, the Board may at its discretion hold public hearings when it decides that such hearings will be in the public interest. Section 2.  Notice of the time and place of such hearings shall be published in the official newspaper of the county or in a newspaper of general circulation at least fifteen days before the time of public hearing and be posted on public bulletin boards at conspicuous places throughout the county. Section 3.  The case before the Board shall be presented in summary by Secretary or a designated member of the Board and parties in interest shall have privileges of the floor. Section 4.  A record shall be kept of those speaking before the Board. 

Article VI  Amendments

 

These by-laws may be amended by a two-thirds vote of the entire membership of the Engineering Review Board.
