WELCOME TO THE HAYWOOD COUNTY REGISTER OF DEEDS WEBSITE:

 

The Register of Deeds is the custodian and manager of a large number of public records. The public records archived in our office include: Haywood County real estate transactions, vital records (Haywood County births and deaths) and marriage licenses issued in Haywood County. We are also honored to serve our retired military by recording their form DD214 military discharges and issuing certified copies to them free of charge.

The care, maintenance and access to these public records are governed by law. It is the mission of the Haywood County Register of Deeds to record, preserve and provide access to these real estate and vital records in an efficient manner according to the North Carolina General Statutes. The Haywood County Register of Deeds staff is fully committed to providing courteous and professional service to our customers.

RECORDING A DEED

The Register of Deeds office files all deeds recorded for land transactions in Haywood County. After approval from the review officer in the Land Records office, the original notarized deed is recorded in the Register of Deeds office. The original copy of the deed is indexed, probated and is scanned once it has been filed. The original copy is returned within 24 hours. The cost of the deed is $19.00 for the first page and $3.00 each additional page.

If any money exchanges hands between parties the excise tax is placed on the deed at the time of recording. The cost is $2.00 per thousand of the TOTAL purchase price. The stamp is normally paid by the Grantor of the deed. The recording fee is normally paid by the Grantee of the deed. If there is no consideration, please state "0" on the deed. The Land Records office needs the grantees mailing address for the taxbill. Please send check or money order and self addressed stamped envelope for return when mailing in the original deed.

The Register of Deeds office maintains a record of all real estate transactions in Haywood County beginning in 1808 to present day.

RECORDING A PLAT

The Register of Deeds Office files all survey maps recorded in Haywood County. After proper approvals from the Haywood County Review Officer located in the Land Records Department and the Haywood County Planning Department if necessary, a mylar copy is filed in the Register of Deeds Office. The cost to record a plat is $21.00. The mylar copy is filed and scanned into our computer system for public access. All copies of survey plats recorded can be obtained for $2.00. VITAL RECORDS

The Register of Deeds office files all birth certificates for people born in Haywood County. The births begin in 1913. A certified copy of a birth certificate is $10.00. This copy may be used for any legal purpose. A plain copy is $.25.

The Register of Deeds office files all death certificates for Haywood County. The deaths begin in 1913. A certified copy of a death certificate is $10.00. This copy may be used for any legal purpose. A plain copy is $.25.

Please send a note with all the information such as name at birth or death, date of birth or death, parents name with the mothers maiden name, your signature now and provide a self-addressed stamped envelope for the return. Please include your phone number if we need to call you if there is a problem.

MARRIAGE LICENSES

The Register of Deeds Office issues and records licenses for marriages performed in Haywood County. The requirements are as follows:

Marriage License fee is $60.00.

No waiting period, no blood test, no physical required.

The marriage license is valid for 60 days from the date of issue or the marriage can be performed the same day.

The license is valid in any county in North Carolina as long as it is returned to the Register of Deeds in the county in which it was issued. Failure to do so subjects the person performing the cermony to a $200.00 fine.

In North Carolina only a minister authorized by his/her church or magistrate can perfom weddings. The minister or magistrate must be presented with a valid marriage license before the marriage can be performed.

Both parties must appear before the Register of Deeds staff. Both parties must present a valid drivers license or valid picture ID or certified birth certificate.

Both parties must be 18 years of age.

Both parties must provide proof of social security number.

If either party has been married before, please know the month and year of how the last marriage ended.
